Thomas Allchin – 1826 (Prob 11/1713)

This is the last Will and Testament of me Thomas Allchin of King Street St Giles in the Fields in the County of Middlesex Dealer in Wines and Spirits I give and devise my freehold messuage or tenement numbered 45 in King Street aforesaid unto my son Francis Alfred Allchin his heirs and assigns for ever but in case my said son Francis Alfred Allchin shall before he attains the age of twenty two years become legally entitled to the messuage or tenement in which I now dwell called or known by the name of the Two Spurs then I give and devise my said messuage or tenament numbered 45 in King Street aforesaid unto my son Charles Allchin and to his heirs and assigns for ever my freehold messuage or tenement numbered 44 in King Street aforesaid I give and devise unto my two daughters Louisa and Emma and their heirs and assigns for ever as tenants in common and not as joint tenants my messuage or tenement in Wormwood Street Bishopgate London called or known by the name of The Ship I give and devise unto my daughter Jane Ann her heirs executors administrators and assigns my messuage or tenements in Shorts Gardens in the county of Middlesex numbered 14 and all my estate and interest therein and in case any of my daughters die under the age of twenty one years without leaving lawful issue then I give and devise the estate share and interest of her or them so dying unto the surviviors or survivor of them my said daughters their and her heirs executors administrators and assigns for ever I give devise and bequeath all other my Estate and Effects whatsoever unto William Grimstone of King Street aforesaid tobacconist and John Saunter (?) of Long Acre surgeon their heirs executors administrators and assigns in Trust to sell and dispose of the same by public auction or private contract as to them shall seem most proper for the best price or prices that can be gotten for the same and to collect and get in all debts and sums of money which may be owing to me at the time of my decease and after paying thereout my just debts funeral and testamentary expenses In Trust to invest the monies to arise from such sale or sales and to be collected and got in in the Public Government Funds and to pay and apply the annual interest and dividends thereof for and towards the maintenance support and education of my dear wife and my five children during the respective minorities of my said children and when and as my children shall have attained the age of twenty two years In Trust to pay distribute and divide the monies so to be invested as aforesaid as follows that is to say one third part thereof to my said dear wife and the remaining two third parts thereof unto between and amongst my said five children – Francis Alfred Charles Louisa Emma and Jane Ann or the issue of such of them as shall be then dead such issue to take a parents share only and in case any of my said children shall die under the said age without issue In Trust to pay distribute and devise the share or shares of him her or them so dying unto the survivors or survivor of them at such time or times as his her or their original share or shares would become due and payable I direct that the rents and profits of my real estate hereinbefore devised to my said children shall during their respective minorities be received by my Trustees and Executors hereafter named and invested in the Public funds for the benefit of each child respectively entitled under this my will so that each childs share may accumulate and that when and as each child shall attain the age of twenty two years the respective accumulation of his or her rents and profits shall be assigned to the child entitled to the property devised to him or her and be subject and liable to such benefit of surviviorship and accrual as hereinbefore declared with respect to the residue of my personal estate provided always and I hereby declare that it shall be lawful for my said Trustees and Executors to pay or advance any part of such rents and profits or the accumulations of the same for an apprentice fee or fees or otherwise for the advancement in the world of any of my children and for better enabling my dear wife to bring up and educate my children I authorise my said Trustees and Executors to allow my wife to carry on my present Trade or any other Trade or business until all my children shall attain the age of twenty two years and for that purpose to suspend the sale of such part of my property as they may think proper and to allow my said wife to have the use of the same and to advance and lend to my said wife such sum or sum sof moneyas they may think proper to enable her to carry on such Trade or business provided they cause my said wife to give security for the same by her Bond and Warrant of Attorney to confess(?) a judgement thereon and I do hereby appoint the said William Grimstone and John Saunter Executors and Trustees of this my Will and Guardians as well of the persons as of the Estates of my said children during their respective minorities and I declare that receipts of my said Trustees and Executors for any part of the purchase money of my Estate and Effects shall be sufficient discharges to the persons paying the same for so much as shall be therein or thereby expressed or acknowledged to be received and that the purchasor or purchasors shall not afterwards be compelled or obliged to see the application of the same or be answerable or accountable for the loss or misapplication of the same and that my said Trustees and Executors or either of them shall not be answerable or accountable the one for the other of them but each for himself only and for his own separate acts receipts and wilful defaults nor shall they or either of them be answerable for more money than they shall respectively actually receive nor for any money for which they or either of them shall give or sign any receipt or receipts for conformity only nor for any casual or involuntary loss which may happenof the said Trust property and effects so as the same happen without their respective wilful default and that they and each of them shall and may out of the Trust property reimburse themselves all such costs and expenses as they may necessarily sustain or to be put to in the execution of this my will or the trusts relating thereto and I give to the said William Grimstone and John Saunter the sum of ten pounds each as a small acknowledgement for the trouble they will have in the execution of this my will In witness whereof I have hereunto set my hand and seal the 13th day of March in the year of our Lord 1826 Thomas Allchin signes sealed published and declared by the said Thomas Allchin the Testator as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses Wm Hodson Atty St John Street Road Clerkenwell John Davey Printer 15 Proved at London 21st June 1826 before the worshipful Charles Coote Dr of Laws and Surrogate by the oaths of William Grimstone and John Saunter the Executors to whom admon was granted being first sworn duly to administer
